These terms and conditions apply to competitions and prize draws operated by Visit Devon. Any additional terms specific to an individual competition will be stated on the relevant competition page and will form part of these terms and conditions.
Entry Requirements
- Competitions are open to residents of the United Kingdom aged 18 or over, unless otherwise stated on the individual competition page.
- Employees, volunteers and representatives of Visit Devon, the prize provider or promoter, their immediate families, and anyone professionally connected with the competition are not eligible to enter.
- To enter, entrants must complete the relevant competition entry form and provide all required information before the stated closing date and time.
- Only one entry per person will be accepted unless otherwise stated. Duplicate entries will be disregarded.
- Entries submitted after the closing date will not be accepted.
- Third-party, bulk, automated or computer-generated entries are not permitted.
- Visit Devon accepts no responsibility for entries that are incomplete, delayed, lost, misdirected or not successfully received due to technical, communications or other problems outside its reasonable control.
- No purchase is necessary to enter unless specifically stated.
The Prize
- The prize will be described on the individual competition page. Any restrictions, exclusions, booking requirements or validity periods stated on that page form part of these terms and conditions.
- Prizes are subject to availability and must be booked and/or redeemed within any dates specified by Visit Devon or the prize provider.
- Unless expressly included in the prize description, travel, transport, meals, drinks, insurance, spending money and any other costs or expenses associated with claiming or using the prize are the responsibility of the winner.
- Accommodation, attraction tickets, experiences and other tourism-related prizes may be subject to availability, excluded dates, seasonal restrictions and the individual terms and conditions of the prize provider.
- The prize is non-transferable, non-refundable and cannot be exchanged for cash or any other alternative.
- Visit Devon accepts no responsibility for inaccurate or incomplete prize information supplied by a third-party prize provider, although reasonable efforts will be made to ensure competition information is accurate.
- Where circumstances outside the reasonable control of Visit Devon or the prize provider make it necessary to do so, Visit Devon reserves the right to substitute the prize with an alternative of equal or greater value.
Selecting and Contacting the Winner
- Unless otherwise stated, the winner will be selected at random from all valid and eligible entries received before the competition closes.
- The draw will normally take place within seven days of the competition closing.
- The winner will be contacted using the contact details provided when entering and may be required to confirm their eligibility before receiving the prize.
- If the winner does not respond within seven days of being contacted, cannot be contacted using the details provided, is found to be ineligible, or is unable to accept the prize in accordance with these terms, Visit Devon reserves the right to withdraw the prize and select another eligible winner.
- The winner’s contact details will be shared with the relevant prize provider, who will contact the winner directly with information about how and when their prize can be booked, collected or redeemed.
- Where required by applicable promotional rules, Visit Devon may make available information sufficient to demonstrate that a valid award has taken place. Visit Devon will take reasonable steps to protect the privacy of winners where appropriate.
Data Protection and Communications
- Personal information supplied as part of the competition will be processed in accordance with applicable UK data protection legislation and Visit Devon's Privacy Policy.
- Entrants' details will be used to administer the competition, verify entries, select and contact the winner and arrange delivery or redemption of the prize.
- Where necessary to administer or fulfil the prize, the winner's details may be shared with the relevant prize provider.
- Entering a competition does not automatically subscribe an entrant to marketing communications from Visit Devon or the prize provider. Where entrants are given the option to receive marketing communications, this will be clearly stated and consent will be collected separately where required.
- Entrants may unsubscribe from marketing communications at any time without affecting their competition entry.
Social Media Competitions
- Where a competition is promoted through Facebook, Instagram or another social media platform, the promotion is not sponsored, endorsed, administered by or associated with that platform unless expressly stated otherwise.
- Entrants release the relevant social media platform from any responsibility in connection with the promotion to the extent permitted by law.
- Entrants must comply with the terms and conditions of the relevant social media platform.
General Terms
- By entering a competition, entrants confirm that they have read, understood and agree to be bound by these terms and conditions together with any additional terms stated on the individual competition page.
- Visit Devon reserves the right to verify the eligibility of entrants and to disqualify any entrant where there are reasonable grounds to believe that these terms have been breached or that an entry is fraudulent, automated or otherwise unfair.
- Visit Devon reserves the right to cancel, suspend, extend or amend a competition where circumstances outside its reasonable control make this necessary. Where possible, any significant changes will be communicated through the relevant competition page.
- Visit Devon will not be responsible for any failure or delay in performing its obligations where this results from circumstances outside its reasonable control.
- Nothing in these terms and conditions excludes or limits any liability that cannot legally be excluded or limited under UK law.
- If there is any conflict between these general terms and specific terms published on an individual competition page, the specific competition terms will take precedence.
- These terms and conditions are governed by the laws of England and Wales, and entrants are entitled to any mandatory protections provided by the laws applicable to them.
